Wrongful Termination In Florida

Legal analysts acknowledge that wrongful termination is difficult to prove in Florida. That is because in Florida, employment is "at will": an employer may terminate an employee at any time, and for any reason, so long as the reason does not conflict with anti-discrimination laws. In Florida, it is illegal to fire someone based solely upon their race, color, sex, religion, national origin, age, disability, political affiliation, pregnancy, or marital status. In addition, Florida has recently added laws that make it illegal to fire, or not hire someone based solely on the perception that they might have AIDS, or AIDS-related symptoms. Neither may business owners require mandatory AIDS testing as a condition of hiring a potential employee, or of offering a current employee continued job status.
