Wrongful Termination Claim

If an employee has been fired for what he believes is not a legally viable reason, he may file suit for wrongful termination. This can be difficult, since most employees are "at will"; that is, they serve at the pleasure of their employer, who may relieve them of their duties for any reason. That being the case, employees are legally forbidden from discriminating against their employees because of their race, age, religion, and other factors. If it can be proven that a person was fired for a discriminatory reason, then the aggrieved party may receive a verdict in his favor. If this is the case, he may be eligible for back pay, monetary damages, and other benefits. However, most wrongful termination claims are settled out of court.
