Employment Termination Agreement

An employee termination agreement, also called a severance agreement or general release, is a document presented to an employee that stipulates the terms for his loss of job. It spells out in detail how much severance pay he is entitled to, how long his health benefits will continue, and other details. In return, the employee usually must agree to forfeit certain rights. For instance, he agrees to keep certain business practices or trade secrets confidential, and that he will not sue his soon-to-be former employer for breach of contract or discrimination. For these reasons, employers may try to pressure employees to sign an employment termination agreement right away. However, especially if the employee feels his rights might be violated, he has the right to review the agreement, to confer with legal counsel, and renegotiate the terms therein.
