Employment Agreement

An employment agreement is an agreement between an employer and an employee (usually an independent contractor). This agreement, or contract, specifies the obligations of the former to the latter (e.g., salary and benefits), and the responsibilities of the latter to the former (i.e., specifics on what job tasks he is required to perform, and the level thereof). An employment agreement is especially important when an independent contractor who creates "intellectual property" is involved. In most cases, if an employee of an organization creates intellectual property, it belongs to the employer. This is not necessarily the case with an independent contractor. With that in mind, an employment agreement specifies who owns the intellectual property, as well as the terms and legalities therein. Furthermore, an employment agreement specifies the length of employment, confidentiality agreements, and other related issues.
